This is the document the legislation asks for. We inspect the pool or spa barrier against the prescribed safety standard — AS 1926.1–2012, applied under Part 5A of the Building Act 2004 — and issue a compliance certificate.
Where the barrier complies, the certificate is issued and lodged with the ACT Government within the 30 days the legislation allows. Where it doesn’t, you get a written notice setting out each item and a period to rectify. You fix them, we verify, the certificate follows.

Then this is the one you need, and the deadline is 1 May 2028 — — days away.
During the transition period — up to 30 April 2028 — an owner selling or leasing a property with a pool has to give the buyer or tenant the Minister’s guidance material along with one of a short list of documents. A disclosure statement is one of them.
It records the age of the pool and its status against the prescribed safety standard, including any non-compliances we identify, so a buyer or tenant knows what they are taking on. It satisfies the disclosure obligation without certifying the pool.
A disclosure statement is a transaction document, not a substitute for certification. If the pool was built before 1 May 2013, the compliance certificate is still required before 1 May 2028.
